Yes. Crimson Insights provides patent invalidity searches to support counsel preparing for inter partes review (IPR) proceedings. We investigate prior art relevant to selected patent claims and organize technical findings for the legal team’s assessment. Explore our invalidity search service.

Focus the search on the intended proceeding

An IPR search needs a scope appropriate to the proceeding. The USPTO explains that IPR challenges are limited to grounds under sections 102 or 103 based on patents or printed publications. USPTO guidance

Counsel defines the claims, relevant dates, and legal assumptions for the engagement. These provide the framework for the technical investigation.

Investigate the selected claim limitations

Crimson’s claim-focused methodology examines the technical features that need to be found in earlier disclosures. We investigate terminology, classifications, citations, patent families, and related research to develop search leads.

The objective is to identify relevant disclosures and make their connection to the selected limitations clear—not simply return documents discussing the same general technology.

Search patent and non-patent publications

Depending on the technology and agreed scope, research can include US and international patent publications, scientific papers, conference proceedings, technical standards, and other potentially relevant publications.

For non-patent material, technical relevance is only part of the assessment. Counsel also needs to evaluate whether the document qualifies as a printed publication and meets the applicable prior-art requirements.

Keep document versions and dates visible

A standards document, paper, or technical manual may exist in several versions. The content of a later revision should not be assumed to appear in an earlier one.

The agreed reporting should distinguish the version reviewed, available publication information, and unresolved date or source questions. This helps counsel identify where additional evidence or investigation may be needed.

Request claim mapping and reporting suited to your matter

Crimson offers claim-limitation mapping where requested within the engagement scope. Reporting can identify relevant passages and figures alongside observations explaining their potential relevance.

Where rolling results are agreed, counsel can review promising references while research continues. Specify the intended chart format, reporting milestones, and delivery date when requesting a quotation.

Keep research and legal analysis connected

Our role is to support counsel with technical research. Counsel determines which references and arguments to use, assesses their legal significance, and prepares the petition.

A search finding does not itself establish that a reference is suitable for an IPR challenge or that a petition will succeed.

Discuss your IPR prior art search

Share the patent, selected claims, known references, relevant dates, and preferred timeline. Include any specific technical gaps and claim-mapping requirements.

Crimson offers fixed-fee patent invalidity search engagements, with fees determined by the number of claims and the technology involved.
